Florida Law Has Changed, and the Clock Is Short
Florida rewrote its negligence laws in 2023, and the changes matter to every crash victim. For accidents occurring after March 24, 2023, the statute of limitations for negligence claims is two years, cut down from four. Miss it and the claim is gone regardless of how strong it was.
Florida also now applies a modified comparative negligence rule under section 768.81: if you are found more than 50 percent at fault, you recover nothing. The 14-Day PIP Rule
Florida is a no-fault state. Your own policy’s personal injury protection pays the first $10,000 of medical care and lost wages, but only if you receive initial medical treatment within 14 days of the crash. Waiting to see a doctor does not just hurt your health and your case; in Florida it forfeits benefits. To pursue pain and suffering damages beyond PIP, the law generally requires proving a permanent injury, which makes complete, consistent medical documentation the backbone of the claim.
