Georgia Car Accident Lawyer – Gregory Stuck, Esq.

A Trial Attorney Admitted in Georgia

Gregory Stuck is licensed in Georgia and represents people seriously injured in crashes across the state. Georgia matters are handled by appointment and remotely, with local counsel associated where a case benefits from it, and with the same trial-first preparation behind every case the firm takes.

Two Years, and Sometimes Far Less

Georgia allows two years from the crash to file suit under O.C.G.A. 9-3-33. But claims involving a city, county, or state vehicle or roadway require ante litem notice much sooner, as little as six months. Waiting to get counsel involved is how strong cases die quietly.

The 50 Percent Bar Makes Fault the Whole Fight

Under O.C.G.A. 51-12-33, your recovery is reduced by your percentage of fault, and if a jury puts you at 50 percent or more, you recover nothing. Georgia adjusters negotiate with that cliff in mind, pushing fault percentages toward the midline. Locking down scene evidence, witnesses, and vehicle data early is what keeps the fault story where it belongs.

Georgia Rewrote Its Rules in 2025

Senate Bill 68, signed April 21, 2025, changed Georgia car cases in ways older articles will not tell you. Seat belt non-use is now admissible evidence against a plaintiff in claims filed after that date. Juries now see both what medical providers billed and what was actually paid to satisfy those bills. And arguments for pain and suffering must be anchored to actual evidence. None of these changes reward casual case handling; all of them reward the disciplined, evidence-first preparation this firm was already built on.

What Has Not Changed

Compensatory damages remain uncapped in Georgia; the Supreme Court of Georgia held in Atlanta Oculoplastic Surgery v. Nestlehutt that caps on a jury’s compensatory award violate the state constitution’s inviolate right to trial by jury. The statutes and cases behind this page are collected in the Georgia Law Reference.
